LUQUIK TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern your access to and use of the LUQUIK platform, including the LUQUIK mobile application, website, and related services (collectively, the “Platform”). The Platform is operated by Luquik Tech Private Limited (“LUQUIK”, “Company”, “we”, “our”, “us”). By creating an account or using the Platform, you agree to these Terms. If you do not agree with these Terms, you must not access or use LUQUIK.

1. Electronic Agreement

By creating an account or using LUQUIK, you acknowledge and agree that:

• These Terms constitute a legally binding agreement
• your electronic acceptance has the same legal effect as a physical signature
• LUQUIK may provide notices, disclosures, and communications electronically through the Platform or via email

2. Eligibility

To use LUQUIK, you must:

• be at least 18 years of age
• have the legal capacity to enter into binding agreements
• comply with applicable laws.

By creating an account or using the Platform, you represent and warrant that you are at least 18 years old.

Persons under the age of 18 are not permitted to use LUQUIK.

3. Nature of the Platform

LUQUIK is a technology platform designed to enable users to post requests and connect with other users who may choose to respond to those requests within a geographic area.

The Platform provides tools for:

• posting requests
• discovering nearby requests
• communicating with other users.

LUQUIK does not provide the goods, services, assistance, transportation, delivery, labor, or activities described in user requests.

4. Platform Neutrality

LUQUIK operates solely as a neutral intermediary platform.

LUQUIK does not:

• initiate requests
• select users for interactions
• supervise interactions
• control agreements between users.

LUQUIK is not a party to any agreement, transaction, or arrangement between users.

5. No Agency or Employment Relationship

Users of LUQUIK are independent individuals.

No user is:

• an employee of LUQUIK
• an agent of LUQUIK
• a contractor of LUQUIK
• a partner of LUQUIK
• a representative of LUQUIK.

Users may not represent themselves as acting on behalf of LUQUIK.

6. User Responsibility and Assumption of Risk

Users interact with other users at their own discretion and risk.

Interactions with strangers may involve risks including but not limited to:

• fraud
• misrepresentation
• theft
• harassment
• property damage
• personal injury.

By using LUQUIK, users acknowledge these risks and assume full responsibility for their interactions with other users.

7. LUQUIK Not Responsible for User Interactions

LUQUIK shall not be responsible or liable for any conduct, act, omission, dispute, injury, loss, damage, or claim arising from interactions between users.

This includes interactions occurring:

• within the Platform
• through messaging
• through third-party communication channels
• in person
• outside the Platform.

LUQUIK’s responsibility ends at providing the Platform that enables users to connect.

8. No Verification or Endorsement of Users

LUQUIK does not verify:

• user identities
• background information
• qualifications
• licenses
• reliability.

User profiles, ratings, activity indicators, or response history do not constitute endorsement by LUQUIK.

Users must independently verify other users before engaging in any interaction.

9. No Guarantee of Outcomes

LUQUIK does not guarantee that:

• A request will receive responses
• responding users are genuine
• requests will be fulfilled
• users will appear for meetings
• promises made between users will be honored.

All arrangements occur solely between users.

10. Offline Interactions

Users may choose to meet or interact outside the Platform.

LUQUIK does not supervise such interactions.

Users are responsible for:

• verifying other users
• ensuring their own safety
• complying with applicable laws.

LUQUIK shall not be liable for any consequences resulting from offline interactions.

11. User Disputes

Disputes between users are solely the responsibility of the users involved. LUQUIK is not obligated to mediate, arbitrate, or resolve disputes between users. Users release LUQUIK from claims arising from disputes with other users. LUQUIK may, at its sole discretion, assist in resolving disputes but has no obligation to do so.

12. Account Registration

Users may create accounts using:

• phone number
• email address
• Google login
• Apple login
• Facebook login
• other authentication providers.

Users are responsible for safeguarding their login credentials and all activity conducted through their accounts.

13. User Content

Users may post content including:

• requests
• messages
• responses
• images
• descriptions.

Users retain ownership of their content but grant LUQUIK a worldwide, royalty-free license to host, store, reproduce, and display such content for the purpose of operating the Platform.

Users are responsible for the legality and accuracy of their content.

14. Prohibited Activities

Users may not use LUQUIK to engage in:

• illegal activities
• harassment or threats
• discrimination or hate speech
• scams or fraudulent requests
• impersonation
• sale of illegal or regulated goods
• weapons trafficking
• drug distribution
• stolen goods transactions
• sexual services
• violent or harmful conduct.

LUQUIK may remove content that violates these rules.

15. Messaging and Communication

LUQUIK may provide messaging features for communication between users.

LUQUIK does not monitor all communications.

Users are responsible for their communications and interactions.

16. Payments and Transactions

LUQUIK does not process user-to-user payments unless explicitly stated otherwise.

LUQUIK is not:

• a payment processor
• an escrow service
• a broker
• a financial intermediary.

Any payments between users occur solely between those users.

17. Location Services

LUQUIK may use device location to display nearby requests.

Location data may be inaccurate or delayed.

LUQUIK does not guarantee the accuracy of location information.

Users may disable location permissions, but certain features may not function.

18. Safety Guidance

LUQUIK encourages users to:

• meet in public places
• verify identities independently
• avoid sharing sensitive personal information
• report suspicious behavior.

LUQUIK does not guarantee the safety of interactions between users.

19. Reporting and Moderation

Users may report:

• abusive behavior
• illegal content
• fraudulent activity
• harassment.

LUQUIK may remove content or suspend accounts that violate these Terms.

Moderation may occur through automated systems, user reports, or manual review.

LUQUIK is not obligated to monitor all activity.

20. Privacy and Data Use

LUQUIK may collect and process information including:

• name
• phone number
• email
• device information
• location data
• communications between users.

This information may be used to:

• operate the Platform
• improve services
• detect fraud
• communicate with users.

21. Account Deletion

Users may request deletion of their LUQUIK account at any time through the Platform settings or by contacting LUQUIK.

Upon account deletion:

• the user’s profile will be deactivated
• personal data associated with the account may be deleted or anonymized.

LUQUIK may retain certain information where required for:

• legal compliance
• fraud prevention
• dispute resolution
• enforcement of these Terms.

22. Intellectual Property

All intellectual property rights related to LUQUIK including software, design, trademarks, and branding belong to Luquik Tech Private Limited. Users may not copy, modify, distribute, or reverse engineer the Platform.

23. Suspension and Termination

LUQUIK may suspend or terminate accounts for:

• violations of these Terms
• illegal activity
• abusive behavior
• misuse of the Platform.

Users may delete their accounts at any time.

24. Disclaimer of Warranties

The Platform is provided “as is” and “as available.”

LUQUIK makes no warranties regarding:

• availability of services
• accuracy of information
• reliability of users
• success of requests.

25. Limitation of Liability

To the maximum extent permitted by law, LUQUIK shall not be liable for:

• indirect damages
• consequential damages
• loss of profits
• personal injury
• property damage
• disputes between users.

LUQUIK’s total liability shall not exceed the amount paid by the user to LUQUIK in the previous 12 months.

26. Release

Users release LUQUIK and its officers, directors, employees, and affiliates from claims arising from disputes or interactions with other users.

27. Indemnification

Users agree to indemnify LUQUIK against claims arising from:

• their use of the Platform
• their content
• their interactions with other users
• violation of these Terms.

28. Force Majeure

LUQUIK shall not be liable for failure or delay in performing obligations due to events beyond its reasonable control, including:

• natural disasters
• war or civil unrest
• government actions
• cyber attacks
• telecommunications failures
• power outages.

29. Entire Agreement

These Terms constitute the entire agreement between users and LUQUIK regarding use of the Platform and supersede prior communications or agreements.

30. Governing Law

These Terms shall be governed by the laws of India.

Any disputes shall be subject to the jurisdiction of courts located in India.
